The customer acknowledges having read, at the time of placing an order, the conditions expressed on the www.mb-fins.com site and expressly declares having accepted them without reserve. The present conditions of use govern the contractual relations between mb-fins sàrl and their customer, both parties accepting them without reserve.

By putting in an order, you offer to buy the products which you selected on our site. Mb-fins sàrl confirms to the customer the acceptance of their order as well as its evolution at the e-mail address which the customer will have supplied at the time of registration. Mb-fins sàrl reserves the right to cancel any order from a customer with whom there is a dispute concerning the payment of a previous order.
In case of an error in the details of the delivery address and phone number of the consignee, mb-fins sàrl are not responsible for the impossibility to deliver the product. In case of delivery problem coming from the manufacturer (availability), mb-fins sàrl will seek a replacement solution in agreement with the customer.

An accepted order is executed as soon as possible by mb-fins sàrl. Thanks to the partnership with FEDEX the delivery deadline is normally from 3 to 4 working days in Europe for products in stock, and is variable for the customized creations going from 4 to 6 weeks. When your order is shipped, you will receive a confirmation by mail including the tracking number of your parcel.
Upon reception of your order, we check the availability of the ordered product(s). In case of unavailability, within 30 days of the validation of the order, we will either deliver the ordered product to you, or offer you a similar product at a similar price, or return any pre-payment to you (by credit card or Postcard, we debit only the exact amount of the delivery).

Since 1st January 2012, Mb-fins sàrl decided to improve its service to the customer by collaborating with the world famous carrier FEDEX. The delivery time will be significantly reduced and the shipping cost will be offered with following conditions.
Shipping costs may be offered with mentioned conditions but taxes and custom clearance in the country of the delivery are at customer's charge. In the case a shipment is returned for non-acceptance of these costs, the return shipping cost will be charged.
If your order contains several items of various brands, your shipment may be made in several parcels. The shipping is usually achieved by FEDEX or by another carrier depending on the nature of the parcel. Please note that it is necessary to give us a delivery address where the parcel can be received during the day (ex: workplace, etc.), as well as your telephone number during the day.
Possible damage during transport must be announced at once to the carrier. You have to check the compliance of the delivered goods upon delivery and before signing the delivery slip of the carrier. You have to indicate on the delivery slip and through handwritten reserves with your signature any abnormality about the delivery (damaged product). Such verification is considered as made as soon as the buyer, or any person authorized by him/her, has signed the delivery slip. You will also have to indicate the abnormalities by recommended mail and to confirm your reserves to the carrier within 3 working days following the reception of one or several items and to pass on a copy of this letter to the following address. Any mistakenly delivered goods or goods delivered in excess must be returned at once, or at the latest within 7 days or they will be charged.

The buyer benefits from the legal guarantee of the latent defects of the products which he purchased. The duration of the guarantee is of one year from the date defined by the accompanying document (bill), which we kindly ask you to carefully keep. The guarantee from which the buyer benefits after the purchase of the product is personal and not transmissible.
The guarantee does not cover any damage caused by misuse, neglect, bad handling, non compliance with the instructions for use, normal wear, including splinters or scratches of paint, as well as any damage caused by a modification or an unauthorized repair, accident, heat, excessive exposure to the sun or bad storage. Further guarantee does not cover: any damage caused by wrong assembly, use for a service of rental or for teaching purposes, use in rocks, corals or shore break, as well as any impact, shock, deformation against a hard object or any other irresponsible use of the product, including voluntary deformation applied manually.
In case of error, of imperfection or of nonconformity of products, the buyer has 7 days after reception of the goods to return the ordered products to mb-fins.com for exchange or refund without penalty, with the exception of the expenses of return.
Any request for return must be made by e-mail. Please contact us, your return reference number will be communicated to you by e-mail within 48 hours maximum. Any parcel returned without a valid number will be refused. The returned products must be complete, in their state of origin, accompanied by their accessories as well as a copy of the bill to which the return reference number will be added.
The expenses for return are chargeable to the buyer, who must return the products in the mb-fins sàrl packaging or in equivalent packaging in terms of product protection. In case of non compliance with the above measures, processing expenses of CHF 30 will be charged and debited from the amount in favour of the buyer.
In case of dispute, the buyer will first contact mb-fins sàrl, who will endeavour to find with them a solution acceptable for all parties. The present contract is subject to Swiss law. For all the cases not covered by the present terms of sale, the Code des Obligations Suisse applies and resolution will be the exclusive competence of Lausanne Law court (Switzerland).
Mb-fins sàrl cannot be held responsible for damages of any kinds, material as well as immaterial or physical, which could result from bad handling or from misuse of the marketed products. The same applies in case of any modifications of products from manufacturers. The responsibility of mb-fins sàrl will be limited, in any case, to the amount of the order and cannot be challenged for simple errors or omissions which may have persisted in spite of all the precautions taken in displaying the products. The choice and purchase of a product or service are the responsibility of the customer alone. The total or partial impossibility to use the products, in particular because of an incompatibility of the equipment, cannot justify any compensation, refund or challenge of the responsibility of mb-fins.com, except in the case of an obvious latent defect, nonconformity, imperfection or an application of the right of withdrawal.
